GENERAL TERMS & CONDITIONS VALID WITH EFFECT FROM APRIL 4, 2018

The following terms & conditions which are subject to change without notice apply to the Services and Rates offered by Sanguinetti & Company, LLC, issued by Sanguinetti & Company, LLC and all its suppliers and or contractors, (hereby collectively referred to as “the Companies”). It is a condition of making a reservation with the Companies that these terms and conditions are accepted in full and non-adherence to our terms & conditions may lead to withdrawal of rates, release of bookings and termination of travel booking at the client's expense. It is a condition of making a reservation with the Companies that the purchasing traveler, “the client” agrees that these terms and conditions constitute a contract under US Law (State of Florida) between the client and Sanguinetti & Company, LLC.

 

The client agrees irrevocably to the exclusive jurisdiction of the Florida Courts and that in the unlikely event of any dispute or action of any kind against the Companies such dispute or action shall be heard under US Law in the Florida Courts.

 

TRAVEL ADVISORIES The Companies strongly recommend that the client reviews any travel advice that may have been issued by the Government of the country in which one resides, or of which one is a citizen, with respect to travel to and within Kenya or any part of East Africa.

 

SAFARI LODGES AND CAMPS Unless otherwise stated, safari packages include: full board accommodation, 3 meals per person per night booked, purified water, laundry, applicable VAT and transportation of guests in custom built 4WD vehicles, airstrip transfers, excursions daily into the famous Masai Mara National Reserve and surrounding areas. Rates exclude drinks, personal expenses, manyatta entrance fees and Park Fees, unless otherwise stated.

 

INSURANCE It is a condition of using the rates and services offered by the Companies that all clients (including individuals, companies and other legal entities) have in place adequate insurance cover against all risks associated with travel in Africa and it is a requirement of using the services offered by the Companies that all clients (including individuals, companies and other legal entities) take out appropriate travel, medical and other insurance prior to departure from country of origin. A visit to Africa, particularly a safari entails an element of risk and neither the Companies nor their officers and employees shall be liable in way for any loss or damages expenses or costs arising from any incident involving clients (individuals, companies and other legal entities) that may occur whilst using any of the services provided by the Companies or third parties contracted by these companies. It is the responsibility of every client (including individuals, companies and other legal entities) to assess his or her own insurance requirements and to organize appropriate insurance. In the event of failure of any client (individual, company or other legal entity) to comply with these insurance conditions and requirements or to organize appropriate insurance, participation in the travel may be denied.

 

PAYMENT Unless otherwise agreed in writing, a deposit of 50% of flight costs and 50% of accommodation and other services is payable upon confirmation of a booking and the balance is payable 90 days prior to first service date on invoice. Please note that for particularly large groups we may ask for additional advance payments particularly in high season.

 

RATES We endeavor to maintain the quoted rates and advise clients as soon as possible of any increases. However, due to currency fluctuations and increases in costs and taxes beyond our control, we reserve the right to increase rates without notice. All rates are subject to change. Any booking where a deposit has been agreed and paid will not be subject to any such an increase in rates. If the price of an advertised travel package is reduced, we will offer a refund of the difference to any client who has paid the full amount prior to the reduction.

 

CANCELLATIONS *Bookings cancelled or reduced in number between the following number of calendar days, to noon of the travel or service date are charged as indicated below and based on the full amount invoiced for the offered service. This is aside from any non-refundable booking costs:

 > 60 days 20%

59 - 44 days 40%

43 - 30 days 80%

29 days – arrival date 100%

 

*The above applies to all hotel, transport, safari camp and lodge accommodation rates and activity bookings, unless otherwise specifically indicated. It also applies to local tourism efforts and accommodation as offered in the Cultural or Local Experiences.

FLIGHT SERVICES Sanguinetti & Company, LLC reserves and contracts flight services with airlines whose respective terms and conditions of service are accessible on each airline’s main website. All air carriers are independently contracted and are not owned, managed, controlled or operated by Sanguinetti & Company, LLC. When airfare is included in a package price, note that the airline ticket constitutes a contract between the client and the airline (and not Sanguinetti & Company, LLC), even if purchased through Sanguinetti & Company LLC or its affiliates. Sanguinetti & Company, LLC is not liable for, and does not assume responsibility or accept claims with regard to, seat assignments, name changes, schedule changes, flight changes and/or cancellations and special requests. Should a client change or cancel his or her air transportation arrangements before or after travel begins, all airline change and cancellation fees will apply in addition to any service fees that may be charged by Sanguinetti & Company, LLC. Sanguinetti & Company, LLC upholds and extends the same terms and conditions as offered by each booked airline. However, where cancellation or modification occurs, Sanguinetti & Company, LLC charges an additional 15% service fee to the airlines applicable fees. Any other unlisted cancellation, modification or other adjustment to the confirmed booking will be chargeable at the sole discretion of Sanguinetti & Company, LLC.

FUEL SURCHARGE FUEL PRICES IN EAST AFRICA ARE CLOSELY LINKED TO THE INTERNATIONAL PRICE OF CRUDE OIL. IF FUEL PRICES INCREASE SIGNIFICANTLY THEN A FUEL SURCHARGE WILL BE LEVIED TO COVER FOR THIS INCREASE. THIS WILL BE COMMUNICATED TO YOU IN ADVANCE. GENERAL CONDITIONS APPLY.

 

ITINERARY CHANGES Sanguinetti & Company, LLC reserves the right to modify program itineraries, including arranged excursions, and substitute accommodations, including road transportation, aircraft and other listed services, at any time due to any unforeseen circumstances or those beyond the Companies’ control. Every effort and then some, is made to operate itineraries as planned and listed, however, alterations may occur after the final itinerary has been advertised or released for booking. We strive to offer comparable alternative arrangements anytime changes are found to be necessary.


PROMOTIONAL VISUALS Sanguinetti & Company, LLC reserves the right to take photographs and video during the operation of any travel package, or part thereof, and to use them for promotional purposes during and after travel. By booking travel with Sanguinetti & Company, LLC, one agrees to allow his or her images to be used in such photographs and video. A client who prefers that their images not be used are asked to email info@sanguinetticompany.com requesting to be left out of any promotional photos or videos that may be taken during travel.

HEALTHY SAFETY To enjoy the packages and trips as intended, a minimum level of fitness or activity is required. A client must provide prior notice to Sanguinetti & Company, LLC if he or she has any physical or other condition or disability that would prevent them from participating in active elements of any trip and/or could create a hazard to him or herself or to other members of the group. The client represents that neither he nor she nor anyone travelling with him or her has any physical or other condition or disability that could create a hazard to himself or herself or other members of the group. For safety reasons, Sanguinetti & Company, LLC reserves the right to decline acceptance of anyone whom it considers unsuitable due to fitness level. Sanguinetti & Company, LLC also reserves the right to remove from the group or travel, at the participant's own expense, anyone whose physical condition or conduct negatively impacts the enjoyment of the other guests or disrupts the trip.

LIMITATION OF RISKS Sanguinetti & Company, LLC, its owners, employees, shareholders, officers, directors, successors, agents and assigns, do not own nor operate any property or entity which is to, or does provide a venue, goods or services included in a travel package. The company purchases transportation (by aircraft, road, water vessel or others), hotel and other lodging accommodations, restaurant meals, entertainment, ground handling and other services from various independent suppliers. All such persons and entities are independent contractors. As a result, Sanguinetti & Company, LLC is not liable for any negligent or willful act of any independent contractor or entity or of any third person. In addition and without limitation, Sanguinetti & Company, LLC is not responsible for any injury, financial or physical loss, death, inconvenience, delay or damage to personal property in connection with the provision of any goods or services whether resulting from but not limited to acts of God or force majeure, illness, disease, acts of war, civil unrest, insurrection or revolt, animals, strikes or other labor activities, criminal or terrorist activities of any kind, overbooking or downgrading of services, food illness, mechanical or other failure of aircraft or other means of transportation or for failure of any transportation mechanism to arrive or depart on time. There are many inherent risks in traveling to Africa, just as there are in traveling anywhere in the world. Greater risks exist when a client agrees to participate in any physical activities including, but not limited to, any fitness programs, excursions involving animals, riding on animals, diving, snorkeling, hot air ballooning, ziplining, high altitude treks, climbing, primate tracking and other adventure experiences. Some risks may lead to illness, injury, or even death. Each client assumes all and any risks associated with participating in any trips or parts of, planned and or sold by Sanguinetti & Company, LLC or the Companies.

CHANGES TO TERMS Sanguinetti & Company, LLC reserves the right to change these terms and conditions at any time without prior notice. In the event that any changes are made, the revised terms and conditions shall be posted on this website immediately: www.sanguinetticompany.com. Client is solely responsible for checking the latest information posted herein to be informed of any changes.
